The rules and regulations of the State of New York Department of Health known as “Medical Facilities—Minimum Standards” (10 NYCRR Subchapter A) specify that a certified registered nurse anesthetist is a qualified practitioner of anesthesia services [Section 405.13(a)(1)(iv)]. The term “certified registered nurse anesthetist” is not defined in the state’s “Medical Facilities—Minimum Standards” rules and regulations, and the Department of Health utilizes the definition found in federal regulations [42 CFR Section 410.69(b)], which includes in the definition of “certified registered nurse anesthetist,” a “graduate of a [nurse anesthesia educational program that meets the Standards of the Council on Accreditation of Nurse Anesthesia Programs who] . . . within 24 months after that graduation meets the requirements of paragraph (4)(i) of this definition [i.e., passes the certification examination].” [Letter dated April 25, 1996, from Maryellen Evans, Provider Group Coordinator, State of New York Department of Health]
