Delaware Practice Law & Requirements

Are advanced degrees currently required?

Advanced practice registered nurse (“APRN”)” means an individual with knowledge and skills acquired in basic nursing education; licensure as an RN; and graduation from or completion of a graduate-level APRN program accredited by a national accrediting body and current certification by a national certifying body in the appropriate APRN role and at least one population focus.” [Delaware Code, Title 24, ch. 19, sec. 1902(b)(1)]

Out-of-State Applicants: “ ‘Scope of Specialized Practice’ That area of practice in which an Advanced Practice Registered Nurse has a Master’s degree or a post-basic program certificate in a clinical nursing specialty with national certification.” [Delaware Administrative Code, Title 24, sec. 8.4]
“ ‘Post Basic program’ A combined didactic and clinical/preceptored program of at least one academic year of full-time study in the area of advanced nursing practice with a minimum of 400 clinical/preceptored hours. The program must be one offered and administered by an approved health agency and/or institution of higher learning. Post basic means a program taken after licensure is achieved.” [Delaware Administrative Code, Title 24, sec. 8.4]

Is there an explicit new graduate provision?

A temporary permit to practice, under supervision only, may be issued at the discretion of the Executive Director provided that:

8.10.2.1 The individual meets the requirements [regarding licensure, application, and fees], and; 8.10.2.2 The individual submits proof of graduation from a nationally accredited or Board approved Master’s or certificate advanced practice nurse program, and;
8.10.2.3 The individual submits proof of admission into the approved certifying agency’s examination . . . and is scheduled to take the first advanced certifying examination upon eligibility. . . or,
8.10.2.4 The individual meets 8.10.2.1 and 8.10.2.2 hereinabove and is awaiting review by the certifying agency for eligibility to sit for the certifying examination.” [Board of Nursing Rules and Regulations, sec. 8.10.2] “A temporary permit will be withdrawn: Upon failure to pass the first certifying examination. The applicant may petition the Board of Nursing to extend a temporary permit under supervision until results of the next available certification exam are available by furnishing the following information: current employer reference, supervision available, job description,
a letter outlining any extenuating circumstances, any other information the Board of Nursing deems necessary.” [Board of
Nursing Rules and Regulations, sec. 8.10.5]

    CRNAs renewing their DEA license or applying for an initial DEA license.
  • Can AANA help me fulfill these requirements?
    Yes, AANA has developed a collection of CE offerings to satisfy these requirements which includes 8 Class A CE (designated as 8 pharmacology credits). This bundle will be available to stream starting June 7 but can be preordered through CKN.
  • When do I need to complete these requirements?
    Starting on June 27, 2023, all CRNAs who are applying for a new DEA license or are renewing their DEA license.
  • The AANA is not listed as an approved provider. Will CE offered by the AANA meet this requirement?
    Yes, through our accreditation with the American Nurses Credentialing Center (ANCC), AANA meets the requirements to offer these CE credits.
  • How do I report the completion of this requirement?
    CRNAs will self-report completion during their DEA licensing process. CRNAs who complete DEA Bundle through the AANA will receive individual certificates documenting the completion of the training. This should be retained as proof of training.

CRNAs are a type of “advanced practice registered nurse.”

“No person shall engage in practice as an advanced practice registered nurse without a Board-issued license as an advanced practice registered nurse.” [24 Del. Code, subsection 1920(b)]
